Environmental Impact Assessment (EIA) Report

Environmental Impact Assessment (EIA) is the process of assessing the likely environmental impacts of a proposal and identifying options to minimise environmental damage. The main purpose of EIA is to inform decision makers of the likely impacts of a proposal before a decision is made. EIA provides an opportunity to identify key issues and stakeholders early in the life of a proposal so that potentially adverse impacts can be addressed before final approval decisions are made (Australian EIA Network)

Description:

+ Survey geographical, geological, meteorological, hydrological conditions
+ Investigate, survey and collect data on natural, environmental, social, economic conditions
+ Collect water, air, soil samples at the site and analyze at laboratory 
+ Determine the microclimate factors in the area
+ Assess the environmental status of the area
+ Identify sources of pollution in the area, such as exhaust gas, wastewater, solid waste, noise; identify the types of waste produced during the construction and operation by statistical methods, analysis, rapid evaluation...
+ Assess level of impact of pollution sources on factors including resources, environment, society, people around the area
+ Give methods to reduce environmental pollution in the period of construction
+ Give methods to reduce pollution, plan for environmental management and prevent environmental incidents
+ Propose methods for wastewater, exhaust gas treatment, collection and treatment of solid waste during operation

+ Consultation from authorised agencies where the project is conducted

+ Build environmental monitoring program

+ Set up committee to appraise and approve of report

I. Object

- Manufacturing enterprises, services, industrial parks, residential areas, urban areas, factories, hospitals, hotels, factories, ... (Projects have scale as in Appendix II of Decree 18/2015/ND-CP dated  on February 14, 2015).

- Have not construct and operate yet.

II. Legal basis

- Environmental Protection Law No. 55/2014/QH13 dated on June 23, 2014.
- Decree 18/2015/ND-CP on environmental protection plan, strategic environmental assessment, environmental impact assessment and environmental protection plan (Article 12-17).
Circular No. 27/2015/TT-BTNMT dated May 29, 2015 on strategic environmental assessment, environmental impact assessment and environmental protection plan. 

III. Necessary documents

- Business registration/ Investment licence
- Agreement on construction site
- Investment report/ Economic and technical report/ Pre-feasibility studies
- Certificate of land use/ Land rent agreement
- Project location map
- Drawings of total premises, storm water drainage, sewage
- Drawings of environmental treatment systems (if any)
In some specific cases, some documents may be required or no need.

 

IV. Authorized agencies

Depending on the scale and location of project, authorized agencies can be:
- Department of Natural Resources and Environment
- Industrial management
- Management of economic zones
- Ministry of Natural Resources and Environment
- Other departments

V. Sanctions violations

- A fine from 200,000,000 to 250,000,000 VND will be imposed if there is no environmental impact assessment report approved according to regulations.
- Detailed regulation in Article 12 of Decree 179/2013/ND-CP on administrative penalties in the field of environmental protection.
