Environmental Protection Schemes

Environmental protection scheme is a legal process that businesses must follow rules established by law. During operation, if the business does not have a certificate of environmental standards or an environment protection commitment or the approval of environmental impact assessment (EIA), these businesses must have environmental protection scheme in detail or in simple, depending on the size and type of project.

Why must you have environmental protection scheme?

The making of the environmental protection scheme is to monitor the evolution of the environment surrounding the project area. At the same time, assess the impact of pollution on the environment for each business to help prevent environmental pollution issues. Since then, the enterprise can build methods to reduce pollution and give appropriate measures.

Description

+ Describe the situation, survey company's operation
+ Survey, collect data on scale of project 
+ Survey, collect data on the current state of the environment surrounding the project area
+ Survey natural, social, economic conditions which are related to the operation of project
+ Identify sources of pollution from the project, such as emissions, wastewater, solid waste and noise; identify the types of waste generated during the operation of project.
+  Assess the impact of pollution factors on environmental resources
+ List and evaluate the overall solution, the items for environmental protection
+ Give measures to reduce pollution and prevent environmental incidents for the existed items 
+ Propose method for wastewater, exhaust gas treatment, plan for collection and treatment of solid waste from operation of the project.
+ Set up program of environmental management and monitoring
+ Prepare relevant documents, records 
+ Send documents to authorized agencies
 (Natural resources and environment division or Natural resources and environment department).
 

I.  Object

1. For Detailed environmental protection scheme

Manufacturing, trading and service facilities which have already operated before April 1, 2015 have scale, properties equivalent to objects in Clause 1, Article 12 of Decree No. 18/2015/ND-CP, but do not have decision approving the environmental impact assessment. It is specified in detail in Appendix 1a promulgated with Circular 26/2015/TT-BTNMT.

2. For Simple environmental protection scheme

Facilities which have already operated before April 1, 2015 have scale, properties equivalent to objects in Clause 1, Article 18 of Decree No. 18/2015/ND-CP, but do not have environmental protection commitment and are specified in detail in Appendix 1b promulgated with Circular 26/2015/TT-BTNMT.

II. Legal basis

  • Environmental Protection Law No. 55/2014/QH13 dated on June 23, 2014.
  • Decree No. 18/2015/ND-CP on environmental protection planning, strategic environmental assessment, environmental impact assessment and environmental protection plan (Clause 2, Article 22)
  • Circular 26/2015/TT-BTNMT dated May 28, 2015 on detailed environmental protection scheme, simple environmental protection schemes.


III. Necessary documents

- Business registration/ Investment licence
- Certificate of land use/ Land rent agreement
- Project location map
- Drawings of total premises, storm water drainage, sewage
- Drawings of environmental treatment systems (if any)

- The existing environmental documents: registration of hazardous waste owner, contract of collection and treatment domestic solid waste, industrial and hazardous waste...

In some specific cases, some documents may be required or no need.

 

IV. Sanctions violations

A fine from 100,000,000 to 150,000,000 VND will be imposed if there is no implementation of all contents in approved environmental protection scheme .

Detailed regulations are in Article 11 of Decree 179/2013/ND-CP on administrative penalties in the field of environmental protection.
