According to Circular 27/2015/TT-BTNMT: All businesses must establish environmental monitoring reports to monitor the waste generated during the preparation, construction and operation of project.

I. Object
All production, business facilities need to establish environmental monitoring report.

II. Legal basis
+ Environmental Protection Law No. 55/2014/QH13 dated on June 23, 2014
+ Decree No. 18/2015/ND-CP dated February 14, 2015 on strategic environmental assessment, environmental impact assessment and environmental protection plan.
+ Circular No. 27/2015/TT-BTNMT dated May 29, 2015 on detailing some articles of Decree No. 18/2015/ND-CP.

III. Necessary documents
+ Business registration/ Investment licence
+ Certificate of land use/ Land rent agreement
+ The decision approving environmental impact assessment / Detailed environmental protection scheme details or confirmation letter of committed to  environmental protection commitment/ Simple environmental protection scheme
+ Hazardous waste owner registration 
+ Contract of collection and treatment of hazardous waste, non hazardous solid waste and domestic solid waste
+ Confirmation of the completion of works, environmental protection measures

In some specific cases, some documents may be required or no need.

IV. Authorized agencies

- For enterprises that have decision of approving Environmental impact assessment (or Detailed environmental protection scheme): submission to the Department of Natural Resources and Environment, Branch of Environmental Protection. 
- For enterprises that have decision of approving Environmental protection commitment (or Simple environmental protection scheme): submission to Natural Resources and Environment Division. 
- For enterprises located in Industrial parks or High-tech zone can submit 1 report to Management Board (optional).

V. Duration

Based on The Commitment (Chapter 4) in the Environmental impact assessment report or Environmental protection scheme or Environmental protection commitment, every enterprise has different time to make Environmental monitoring report.

VI. Implementation process

- Survey, preliminary estimate of facility
- Based on production technology, assess pollution sources arising such as wastewater, exhaust gas, solid waste, hazardous waste
- Assess each source of pollution and other types of waste generated by each source in detail.

- Measure, analyze wastewater, exhaust gas samples according to National Regulation of Vietnam.
- Based on National Regulation of wastewater, exhaust gas, assess the actual analysis results to determine the quality of existing environment.

- Propose measures to reduce pollution in facility in the present and future (if any) 
- Submit to the authorized agencies

VII. The number of emissions, wastewater samples need to be measured

Based on The Commitment (Chapter 4) in Environmental impact assessment report or Environmental protection scheme or Environmental protection commitment, each enterprise has different number of samples to be measured. However, for enterprises do not have any above documents, the number of samples will be estimated when surveying or based on preliminary information.
